The circumstance of aggravation under s 8(d) of the Drugs Misuse Act 1986 (Qld) — that the quantity of a dangerous drug exceeds the prescribed amount — can only be established by proof that the actual quantity of the drug produced exceeded the prescribed amount; it is not sufficient to prove that precursor chemicals were present in quantities capable of producing more than the prescribed amount. However, the quantity of precursor chemicals remains relevant to the overall criminality of the production offence and to sentencing.
