The Court of Appeal held that neither the Director nor Manager of Major Venues had actual or ostensible authority to enter into a contract binding Brisbane City Council to grant a lease of land, and that the Council had not delegated its power to enter into such contracts to those officers. The Court also found that the alleged agreement was unenforceable by reason of s 57(1) of the Land Act 1994 (Qld) and/or was void for uncertainty. The decision confirms that persons dealing with local government officers must verify that the officer has proper delegated authority before relying on representations as to contractual commitments.
