A sentence of nine years' imprisonment for manslaughter was upheld where the accused armed himself with a large knife and pursued the deceased after the deceased had left the premises, notwithstanding that the confrontation was initiated by the deceased. The applicant's criminal history of violence offences and recent release from an intensive correctional order were relevant aggravating factors. Byrne J's observation leaves open the question of whether resource savings from an unaccepted offer of a guilty plea to a lesser charge should attract a sentencing discount.
