A pre-existing settled sexual relationship between offender and victim does not establish a sentencing principle of inflexible or universal application requiring mitigation for rape. While such a relationship may be a mitigating factor where the impact on the victim was demonstrably less traumatic, it may equally aggravate the offence. Courts have a heightened obligation to deter those in prior relationships from treating former partners as objects for sexual gratification.
