A sentencing court may properly take into account threats of further violence made at the time of the offence and subsequent conduct demonstrating an intention to carry out those threats, without offending the De Simoni principle against punishing for uncharged offences, where those matters form part of the circumstances of the offence itself. The mitigating effect of a psychiatric condition such as morbid jealousy is substantially reduced where the condition is at least partially self-induced through drug abuse.
