A planning commission's refusal to endorse subdivision plans pending appeal of conditions of approval does not constitute contempt of court where the refusal is based on a plausible interpretation of the statutory scheme and concern for third-party purchasers, even where the refusal causes financial pressure to the subdivider. Reliance on legal advice is not a complete defence to contempt but is relevant to penalty. A single judge should only exercise contempt powers outside O 55 in the most exceptional circumstances.
