Where information before a sentencing judge — whether from counsel or a pre-sentence report — reveals a history of mental disorder, the judge has a duty to make inquiries into whether the mental condition could mitigate the offence. Failure to do so constitutes a miscarriage of the sentencing discretion. On resentencing, the appellate court may receive and act upon medical evidence not before the sentencing judge.
