Where a Magistrate fails to make a parole eligibility order without expressly declining to do so or giving reasons, the omission may be treated as an administrative oversight rather than a deliberate decision, particularly where the circumstances would support parole eligibility. Natural justice requires that an offender have an opportunity to object to or correct errors in each individual sentence at the time it is imposed, even when sentencing by video link. The question whether failure to particularise individual sentences in the offender's presence renders the sentencing a nullity under s 14 of the Sentencing Act 1995 (WA) was left open.
