Where offences of murder are at the upper end of seriousness, involving premeditated armed home invasion resulting in death, the factors of general and personal deterrence may be so dominant that the mitigating effect of the offender's youth (18 years) and psychological condition (ADHD) has finite limits in reducing the minimum term. A 12-year minimum term for an 18-year-old principal offender in such circumstances was held to be within range.
