The Court of Appeal cannot grant prerogative relief in the nature of mandamus or prohibition directed to a judge sitting in a Division of the Supreme Court. Section 48(2) of the Supreme Court Act 1970 (NSW) is limited to specified tribunals and does not extend to Divisions of the Court. Litigants dissatisfied with orders of a Supreme Court judge must pursue the appellate avenue rather than seeking prerogative relief.
