The Supreme Court of NSW cannot be used as a venue for summary criminal prosecution of either state offences not listed in Schedule 10 of the Crimes Act 1900 (NSW) or federal offences, because s 68(2) of the Judiciary Act 1903 (Cth) does not alter the position — the Supreme Court is not a 'court of summary jurisdiction' within the meaning of s 26 of the Acts Interpretation Act 1901 (Cth). A determination by the Supreme Court that it lacks summary criminal jurisdiction is an exercise of civil jurisdiction, challengeable in the Court of Appeal (not the Court of Criminal Appeal), and only by leave.
