Where co-offenders receive identical sentences but one played a clearly more senior role and had significantly more Form 1 matters, the subordinate offender may have a justifiable sense of grievance warranting reduction of sentence, even where the sentence is otherwise lenient. Self-serving statements in pre-sentence reports that are not supported by evidence and not accepted by the Crown should be ignored or given limited weight. A Crown concession at sentencing does not bind the court, but may be relevant on a defence appeal if the offender was prejudiced by relying on it.
