A trial judge may direct the jury on an alternative basis for conviction not advanced by the Crown, provided the accused is not placed at a tactical disadvantage rendering the trial unfair. Where the evidence does not raise any issue of involuntariness or accident in a felony murder case, the trial judge is entitled to direct the jury that no such issue arises rather than leaving it as a jury question.
