Section 270.6(2) of the Criminal Code Act 1995 (Cth) creates a single offence with alternative fault elements of knowledge or recklessness, not two distinct offences. The statutory definition of 'sexual servitude' in s 270.4 does not require that the person actually attempted to leave or cease providing services; it is sufficient that the person was not free to do so should she wish. The force or threats causing the lack of freedom need not be applied by the accused personally. The confiscation of passports, imposition of debt obligations, and implicit threats of consequences for escape are capable of constituting 'threats' within the statutory definition. Sentences of 4-5 years imprisonment for first offences under s 270.6(2) involving multiple victims over several months were upheld as within the permissible range.
