A sentencing judge's failure to expressly state that a guilty plea was taken into account under s 13(3) of the Penalties and Sentences Act 1992 (Qld) does not invalidate the sentence by virtue of s 13(5). Changed circumstances arising after sentence, such as the birth of a child while on bail pending appeal, may render an otherwise appropriate sentence manifestly inappropriate, warranting variation on appeal.
