The Queensland Court of Appeal (McPherson and Williams JJA, Holmes J dissenting) held that a sentence of two years' imprisonment suspended after three months for dangerous operation of a motor vehicle causing death was manifestly inadequate. The Court substituted a sentence of two years' imprisonment suspended after 11 months with a four-year operational period, applying the sentencing range established in R v Melano and R v Balfe for this category of offence.
