A sentence of 18 months imprisonment with parole after nine months is within the appropriate range for dangerous operation of a vehicle causing death where the driving involved turning across oncoming traffic on a red arrow due to a continuing failure to keep a proper lookout, even where the offender has no criminal history, good character, and a dependent family. Such driving is properly characterised as more than momentary inattention and requires actual imprisonment. Fryberg J left open the question of whether the victim's possible contributory conduct (excessive speed) and the offender's relative causal contribution to the death are relevant sentencing considerations.
