An appeal under s 341(2) of the Industrial Relations Act 1999 (Qld) lies from any decision of an Industrial Magistrate made 'in relation to' a matter for which the Magistrate has jurisdiction under s 292(1), including interlocutory decisions such as leave to appear, even if the decision itself is alleged to be beyond the Magistrate's power. An error by the Industrial Court in determining whether the Magistrate had power to make such a decision goes to the correctness of the Industrial Court's decision, not to the existence of its jurisdiction, and is therefore protected by the privative clause in s 349.
