In multi-complainant sexual offence trials, a direction to consider each count separately is insufficient; the trial judge must also give a propensity warning directing the jury not to reason that the accused is the kind of person likely to have committed the offences charged. Directions on uncharged acts must clearly identify the limited purpose for which the evidence is admitted and the specific relationship to which it relates. A trial judge should not direct on consciousness of guilt where the Crown has not relied on the evidence for that purpose and the evidence is not reasonably capable of supporting such an inference.
