Where an offender confesses and cooperates with authorities but there is unexplained delay in laying charges, the sentencing court must give explicit credit for that delay. This is particularly significant where the offender is held in immigration detention during the delay period, as that time cannot be counted as time served in custody. Substantial cooperation with authorities must always be rewarded, both as a matter of mitigation and to send a general message encouraging cooperation.
