When a sentence is ordered to be served cumulatively on a prior sentence, the operation of s 94 of the Sentencing Act 1995 (WA) may render a declaration of parole eligibility on the later sentence of little practical effect. However, this does not of itself render the sentence erroneous if the term of imprisonment is otherwise appropriate for the offence. A cumulative sentence is justified where the later offence infringes a different legal interest from the prior offences.
