The first limb of the totality principle requires the total effective sentence to bear a proper relationship to the overall criminality, and very substantial mitigating factors (including guilty plea discounts, cooperation discounts, and personal circumstances) must be given appropriate weight in that assessment. A sentencing judge who imposes sentence by reference to the wrong maximum penalty commits an error of law requiring correction on appeal.
