A body corporate that continues unlawful land use despite multiple prior convictions and warnings may properly be fined $122,400 (20% of maximum fixed penalty plus daily penalties) without the sentence being manifestly excessive. There is no requirement for a linear progression of steadily increasing fines across a series of similar offences. The proper course upon first conviction for unlawful land use is to cease the use entirely, not merely to reduce the scale of operations.
