The Full Court of Western Australia confirmed that it has jurisdiction to reopen its own decisions, following the South Australian Full Court's reasoning in McAdam v Robertson, but the jurisdiction is exceptional and will not be exercised merely to allow a party to re-argue its case or improve upon its earlier arguments. An application to reopen should ordinarily be heard by the original coram but may be heard by a differently constituted court where there is good reason. A Master cannot discharge or vary a Judge's direction under s 61 of the Supreme Court Act (WA) as to documents to be referred to at the hearing of an appeal.
