Deterrence is the dominant sentencing consideration for manufacturing methylamphetamine under s 6(1)(b) of the Misuse of Drugs Act 1981 (WA), even where manufacture is for personal use, and personal circumstances cannot be given much weight. Section 87 of the Sentencing Act 1995 (WA) does not permit credit for time spent in custody where the custody was also referable to other charges. However, time spent in custody on charges of which the offender was acquitted may be taken into account as hardship on the basis of considerations of mercy, though it cannot be treated as a 'bank balance' to draw upon for unrelated offences.
