A health service that has assumed responsibility for the care and management of a vulnerable psychiatric patient owes a duty to warn the patient about the risks of social contact with a health worker involved in their treatment, and to warn the health worker against such contact. The foreseeability required is not of the precise event (criminal assault) but of damage of the general type that occurred (harm from an inappropriate sexual relationship). A party that fails to put expert evidence directly to its own witnesses in examination-in-chief cannot later rely on those witnesses' evidence as contradicting the expert opinions.
