Representations made in connection with the settling or bringing of court proceedings, but not in the course of the proceedings themselves, are not precluded from being characterised as made 'in trade or commerce' under s 52 of the Trade Practices Act. A plaintiff claiming under s 52 need not itself have been misled; it may recover for loss caused by others being misled by the defendant's conduct.
