The Crown must lead in chief evidence of the full details of any benefit received by an accomplice witness, including the quantum of the sentence discount, the undertaking given, and the consequences of failing to fulfil that undertaking. A s 165 warning must inform the jury not only that the witness received a discount but that the witness could lose that benefit if the undertaking is not fulfilled. R v Privett is confined to its particular facts involving non-custodial sentences and does not justify withholding details of custodial sentence discounts.
