An offender who offers to plead guilty to a lesser charge that matches the offence of which they are ultimately convicted is entitled to a sentencing discount, even where the Crown rejected the offer and the matter proceeded to trial. The measure of leniency afforded to such an offender should not depend upon the Crown's attitude to the plea offer. A discount at the lower end of the Thomson & Houlton range (10%) is appropriate where the offer was made only in the week before trial.
