Where an offender offers to plead guilty to a lesser charge fairly available on the evidence, and the jury ultimately convicts of that lesser charge, the offender is entitled to a discount on sentence equivalent to the utilitarian value of a guilty plea, even though the Crown rejected the offer and a full trial proceeded. The Oinonen principle survives Thomson and Houlten and Sharma. The fact that the offender raised other defences at trial (such as self-defence) after the plea offer was rejected does not disentitle the offender to the discount.
