A police officer who knowingly allows a drug dealer to continue supplying prohibited drugs in exchange for bribes is at least arguably guilty of 'supply' within the extended definition in s 3 of the Drug Misuse and Trafficking Act 1985 (NSW), on the basis that the officer 'suffered' or 'permitted' the supply by failing to exercise the power to arrest for past offences. The distinction between 'permitting' (actively or expressly allowing) and 'suffering' (passively or implicitly allowing) may be meaningful when the two words are juxtaposed in a statute. The question remains to be definitively determined at trial.
