Where an offender pleads guilty to the alternative charge of stealing from the person in satisfaction of a robbery indictment, the sentencing judge must maintain the distinction between the two offences and must not sentence on a basis that blurs that distinction. The sentencing judge must also spell out how the plea of guilty was taken into account or explain why it was discounted. A 25% discount for a plea of guilty and remorse was applied in this case.
