Under the Testators Family Maintenance Act 1912 (Tas), the test for adult children's claims is twofold: (1) whether the testator as a just parent had a moral responsibility to make provision, and (2) whether the child can establish subjective entitlement. An adult child who is not vulnerable or disadvantaged bears a high burden and must show special need. Estrangement from the testator, absence of contribution to the estate, and financial self-sufficiency weigh heavily against entitlement. The testator's intention, if fair and soundly based, forms a cogent basis for not interfering with the will.
