Where a disproportionate sentence is imposed under s 6D(b) of the Sentencing Act 1991 (Vic) to protect the community, the gap between the head sentence and the non-parole period should be greater, not less, than would otherwise be the case, because of the difficulty of long-range prediction and because the head sentence itself protects the community. The offence of committing an indecent act with a child under 16 does not require physical contact; an indecent act committed in the presence of the child is sufficient. The standard of proof for future dangerousness under the serious sexual offender provisions was left as an open question.
