In culpable driving cases where the evidence as to speed is seriously contested and there are alternative explanations for loss of control, the trial judge must do more than direct the jury in bare terms of 'gross negligence' — the judge must relate the contested facts to the elements of the offence and explain that the standard required is such as to justify the intervention of the criminal law. This obligation exists even in trials predating R v De'Zilwa. Unverified calculations should not be tendered through a defence witness after the prosecution case has closed.
