A non-conviction disposition for armed robbery is only justified in rare and exceptional circumstances, but may be available where the offender is young, has very strong rehabilitation prospects, pleaded guilty at the earliest opportunity, showed deep remorse, and the offending was out of character. The seriousness of the offence does not wholly dictate the sentencing outcome where exceptional mitigating factors are present.
