A medical assessment panel determination under s 145E(5) of the Workers' Compensation and Rehabilitation Act 1981 (WA) is 'final and binding' only in respect of the specific question validly referred to the panel; it does not preclude the application of issue estoppel arising from findings of a court of competent jurisdiction on issues not validly determined by the panel, including causation. A referral under s 84ZM is a referral of the whole matter before the review officer, not merely the question of law.
