Cases of dangerous driving causing death where the driver was affected by a combination of alcohol and fatigue fall within the more serious category of dangerous driving, warranting immediate imprisonment rather than a suspended sentence. The fact that passengers assumed the risk of travelling with the driver or failed to wear seatbelts does not diminish the driver's moral culpability. A trial judge redirecting the jury on the elements of the offence is not required to repeat all arguments advanced on behalf of the defence where those arguments were amply set out in the original summing up.
