When WorkCover determines the classification of an employer's business under clause 2(4) of Schedule 1 of the Insurance Premiums Order, it must identify all classifications that call for consideration and make a global assessment of which most accurately describes the entire business; sequential elimination of classifications is an error of law. Identification of the predominant activity is a relevant and important part of the exercise but cannot substitute for the whole exercise. Claims experience may be used to identify the nature of business activities but not to determine whether a particular premium rate is justified.
