A worker employed by a contractor who performs work in or about a coal mine is a 'coal miner' entitled to enhanced compensation benefits under Schedule 6 Part 18 of the Workers Compensation Act 1987 (NSW); the identity of the employer is irrelevant. The test focuses on whether the worker's actual work at the time of injury was substantially centred in or about the mine, not on the regularity or proportion of time spent at the mine over an extended period.
