An indictment charging multiple accused jointly is to be read jointly and severally, permitting the jury to convict some and acquit others on the same count. Evidence of a complainant's alleged prostitution, including a remark about payment, falls within the blanket prohibition on evidence of sexual reputation under s 293 of the Criminal Procedure Act 1986 (NSW). A jury's failure to convict a co-accused does not negate that person's capacity to be 'in company' for the purpose of the aggravated sexual assault provisions. Sentence structures producing extremely long potential parole periods for a single outbreak of criminality on one night may be excessive.
