The Court issued a detailed guideline for sentencing high range PCA offences. In an ordinary case, an order under s 10 of the Sentencing Act will rarely be appropriate, and a conviction cannot be avoided merely because the offender attended a driver education course. The automatic disqualification period should apply unless there is a good reason to reduce it. For second or subsequent offences, an order under s 9 will rarely be appropriate and an order under s 10 would very rarely be appropriate. Where the prior offence was high range PCA, any sentence less severe than a community service order would generally be inappropriate. Licence disqualification must be taken into account when determining the totality of the penalty.
