A sentencing judge must not decline to find special circumstances and adjust the non-parole period on the basis that the offender is likely to be deported at the end of the non-parole period. Where an offender would otherwise qualify for a finding of special circumstances because they would benefit from a longer period of supervision, such a finding should be made regardless of deportation prospects.
