For deemed supply of methylamphetamine (less than commercial quantity) by a young first offender who pleaded not guilty, a full-time custodial sentence is appropriate but the quantum must be consistent with Judicial Commission statistics. A sentence of 18 months full-time custody was manifestly excessive where refined statistics showed no full-time custodial sentences in comparable cases. Judicial Commission statistics refined to seven cases remain sufficiently reliable where seven limiting factors were applied to a dataset of over 600 cases.
