Homophobic motivation for an assault is a proper aggravating factor that may justify a custodial sentence even for a young first offender. The principle that imprisonment is a last resort for young offenders is expressly qualified by s 9(3) of the Penalties and Sentences Act 1992 (Qld) for offences of violence causing physical harm, and youth does not confer immunity from imprisonment for serious violent offending.
