Hardship to third parties, including the offender's role as sole carer of a young child, may only justify departure from an otherwise appropriate custodial sentence in truly exceptional or extreme circumstances. Where the child will not be left without care (e.g., Department of Family Services can provide care), the circumstances are not exceptional. For dangerous operation of a motor vehicle causing death with aggravating factors (prior dangerous driving conviction, significant traffic history, excessive speed in a busy area), the sentencing range is three and a half to four and a half years' imprisonment.
