Acquittals on some counts in a multi-count sexual offence trial do not render guilty verdicts on other counts unreasonable where the acquittals are rationally explicable by independent evidence undermining the dates alleged or by prior inconsistent statements specific to those counts. Late disclosure of medical evidence that adds nothing material to the defence case already before the jury does not result in a miscarriage of justice warranting discharge of the jury. A summing-up on s 229B Criminal Code that, considered as a whole, makes clear the jury must be unanimously satisfied of three specific offences of a sexual nature is not erroneous merely because the judge also referred to uncharged non-sexual acts in the context of proving the continuing nature of the relationship.
