A creditor owed multiple debts by the same debtor is not required by s 459E(1) to include all debts in a single statutory demand; separate demands may be served for each debt exceeding the statutory minimum. The prior line of authority (Sentinel, Hooker Cockram, Leda Developments) holding otherwise was held to be plainly wrong. However, the issue of a large number of demands may still be set aside as oppressive under s 459J(1)(b) depending on the circumstances. A copy of an application to set aside a statutory demand must include the court seal, action number, and return date to constitute a valid 'copy' under s 459G(3)(b).
