The word 'party' in s.25(1)(c) of the Crimes (Criminal Trials) Act 1999 (Vic) includes non-litigants such as persons attending court pursuant to a subpoena, enabling costs orders against solicitors in favour of such persons. A refusal to grant an order in the nature of certiorari is an interlocutory order requiring leave to appeal. An Associate's endorsement on a court file is merely an administrative memorandum and does not constitute authentication of an order for the purposes of the functus officio doctrine.
