A spent conviction order under s 45(1) of the Sentencing Act 1995 (WA) is not precluded by the nature of the offence being a drug offence. Triviality must be assessed by reference to the actual conduct and circumstances, not the class of offence. The discretion may be exercised on the basis of previous good character alone, even where the offence is not trivial. The detrimental effect of a conviction on employment prospects, particularly where police clearances are required for the offender's profession, is a circumstance that may justify the making of a spent conviction order.
